These Terms of Service ("Terms") constitute a legally binding agreement between you and Aurexis Technologies Private Limited ("Pingzo," "we," "us," or "our"). By creating an account or using any part of the Pingzo service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.

1. Acceptance of Terms
By accessing or using the Pingzo platform at pingzoapp.com (the "Service"), you agree to be bound by these Terms of Service, our Privacy Policy (available at pingzoapp.com/privacy), and any additional terms applicable to specific features or services.
These Terms apply to all visitors, users, and customers of the Service, regardless of your country of residence or the device you use to access the Service.
Agreement by Use
If you use the Service on behalf of a company, organisation, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" refers to both you as an individual and the entity you represent.
2. Eligibility
To use Pingzo, you must meet all of the following requirements:
- You must be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher
- You must have the legal capacity to enter into a binding contract in your jurisdiction
- You must not be prohibited from using the Service under the laws of your country of residence or any other applicable jurisdiction
- If using Pingzo for business purposes, your organisation must be a legally recognised entity in its jurisdiction
- You must not be on any government-issued list of prohibited or restricted parties
Pingzo reserves the right to refuse service, terminate accounts, or cancel subscriptions at our sole discretion if we determine that the above requirements are not met.
3. Description of Service
3.1 What Pingzo Provides
Pingzo is a Software-as-a-Service (SaaS) platform that provides:
- Automated HTTP/HTTPS endpoint monitoring at configurable intervals
- Real-time outage detection and alerting via WhatsApp, email, and webhooks
- Public status pages displaying service uptime and incident history
- An embeddable status widget for your own website
- SSL certificate expiry monitoring and alerts
- Incident management and historical uptime reporting
- A user dashboard for managing monitors, alerts, and account settings
3.2 Service Tiers

Full feature details for each plan are available at pingzoapp.com/pricing. We reserve the right to modify plan features with 30 days' advance notice to affected subscribers.
4. Account Registration and Security
4.1 Account Creation
To use Pingzo, you must create an account using Google OAuth authentication. By creating an account, you:
- Agree to provide accurate and complete information
- Authorise Pingzo to access your Google account name, email address, and profile photo
- Agree to keep your account information up to date
- Accept responsibility for all activity that occurs under your account
4.2 Account Security
You are responsible for maintaining the security of your account. You agree to:
- Keep your authentication credentials confidential
- Notify us immediately at admin@pingzoapp.com if you suspect any unauthorised access to your account
- Not share your account with any other person
- Sign out of your account at the end of each session on shared devices
Pingzo will not be liable for any loss or damage arising from your failure to comply with these security requirements.
4.3 One Account per User
Each individual may maintain only one Pingzo account. Creating multiple accounts to circumvent plan limits or restrictions is prohibited and may result in immediate termination of all associated accounts.
5. Subscription Plans and Pricing
5.1 Plan Selection
Pingzo offers both free and paid subscription plans. Paid plans are available on a monthly or annual billing basis. By selecting a paid plan, you agree to pay the applicable subscription fees.
5.2 Pricing
Current pricing is displayed at pingzoapp.com/pricing. Prices are shown in:
- Indian Rupees (INR) for users accessing the Service from India, processed via Razorpay
- United States Dollars (USD) for users accessing the Service from all other countries, processed via Lemon Squeezy
Prices displayed are inclusive of any applicable platform fees but exclusive of local taxes, which may be added at checkout depending on your jurisdiction.
5.3 Price Changes
We reserve the right to change subscription prices at any time. For existing paid subscribers:
- We will provide at least 30 days' advance written notice of any price increase via email
- Price increases will take effect at the start of your next billing cycle after the notice period
- If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect
- Continuing to use the Service after the price change constitutes your acceptance of the new pricing
6. Payment Terms
6.1 Billing
Paid subscriptions are billed in advance:
- Monthly plans: billed once per month on the same date as your initial subscription
- Annual plans: billed once per year on the same date as your initial subscription
- All amounts are due immediately upon billing and are non-negotiable unless expressly stated
6.2 Payment Processing

We do not store your credit card numbers, UPI credentials, or banking details. All payment information is handled directly by our PCI-DSS Level 1 certified payment processors.
6.3 Taxes
You are responsible for all applicable taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service. Where required by law, Pingzo may collect and remit applicable taxes on your behalf. The applicable taxes will be clearly shown at checkout before you confirm your purchase.
6.4 Failed Payments
If a payment fails:
- We will notify you by email immediately
- We will retry the payment up to 3 times over 7 days
- If payment remains unsuccessful after 3 attempts, your account will be downgraded to the Free plan
- Your monitoring data will be retained for 30 days after downgrade to allow you to reinstate your subscription
- We will not immediately delete your monitors or data upon payment failure
7. Refund and Cancellation Policy
7.1 Cancellation
You may cancel your subscription at any time through Settings → Plan & Billing in your Pingzo dashboard, or by contacting admin@pingzoapp.com.
- Monthly plans: cancellation takes effect at the end of the current billing month. You will retain full access until that date.
- Annual plans: cancellation stops automatic renewal. You will retain full access until the end of the current annual period.
- There is no penalty for cancellation at any time.
7.2 Refund Policy

Refunds are processed to the original payment method within 5-10 business days. Processing times may vary depending on your bank or payment provider.
7.3 Service Credits
In lieu of a refund, we may offer service credits at our discretion. Service credits have no cash value and can only be applied to future Pingzo subscription payments.
8. Acceptable Use Policy
8.1 Permitted Use
You may use Pingzo solely for lawful purposes and in accordance with these Terms. Pingzo is designed for monitoring services and infrastructure that you own or have explicit written permission to monitor.
8.2 Prohibited Activities
You agree NOT to use Pingzo to:
- Monitor any URL, API, or system that you do not own or do not have explicit permission to monitor
- Conduct or facilitate Distributed Denial of Service (DDoS) attacks or stress testing of third-party systems
- Perform unauthorised penetration testing or security scanning of systems you do not own
- Circumvent, disable, or interfere with security features of the Service or any third-party systems
- Attempt to gain unauthorised access to any part of the Service or its related systems
- Use automated scripts or bots to create accounts, circumvent plan limits, or abuse the Service
- Monitor government systems, military infrastructure, or critical national infrastructure without explicit authorisation
- Transmit malware, viruses, or any malicious code through the Service
- Violate any applicable local, national, or international laws or regulations
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Resell, sublicense, or commercially exploit the Service without our express written consent
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in any way that could damage, disable, or impair the Service or servers
8.3 Enforcement
Violation of this Acceptable Use Policy may result in:
- Immediate suspension of your account without notice
- Permanent termination of your account
- Reporting to relevant law enforcement authorities
- Legal action for damages caused
We reserve the right to investigate suspected violations. You agree to cooperate with any such investigation and provide information as reasonably requested.
9. Service Availability and Uptime
9.1 No Uptime Guarantee
Important Disclosure
Pingzo provides its monitoring service on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or 100% available service. While we target 99.9% uptime for the Pingzo platform itself, this is an aspiration and not a contractual obligation.
9.2 Scheduled Maintenance
We may perform scheduled maintenance that temporarily interrupts the Service. We will:
- Provide at least 24 hours advance notice for planned maintenance where possible
- Display maintenance notices on our status page at status.pingzoapp.com
- Schedule maintenance during low-traffic periods where possible
9.3 Unscheduled Outages
In the event of an unscheduled outage affecting the Pingzo monitoring service:
- We will post updates on status.pingzoapp.com
- Alerts that were not delivered due to a Pingzo outage will not retroactively be resent
- We will not be liable for any missed alerts, missed incidents, or consequential losses arising from a Pingzo platform outage
9.4 Check Accuracy
Pingzo monitors your endpoints from our infrastructure. Monitor results reflect the availability of your endpoint from our servers and do not necessarily reflect the experience of all your end users globally. Pingzo is not liable for discrepancies between check results and actual end-user experience.
10. Intellectual Property
10.1 Pingzo Intellectual Property
The Pingzo platform, including its software, design, logos, trademarks, text, graphics, and all other content, is owned by or licensed to Aurexis Technologies Private Limited and is protected by intellectual property laws worldwide.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your internal business purposes in accordance with these Terms. This licence does not include the right to:
- Copy, modify, or create derivative works of any Pingzo content
- Redistribute, sell, or sublicense any part of the Service
- Remove any proprietary notices from the Service
- Use Pingzo branding, trademarks, or logos without our prior written consent
10.2 Your Content
You retain full ownership of all data you input into Pingzo, including your monitor configurations, status page content, and account information ("Your Content"). By using the Service, you grant Pingzo a limited licence to process Your Content solely to provide the Service to you.
We will not use Your Content for any purpose other than providing and improving the Service. We will not share Your Content with third parties except as described in our Privacy Policy.
10.3 Feedback
If you provide us with suggestions, feedback, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free licence to use that Feedback for any purpose, including improving the Service, without any obligation to compensate you.
11. User Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy at pingzoapp.com/privacy carefully before using the Service.
Key data commitments:
- We encrypt all stored URL endpoints and authentication headers at rest using AES-256 encryption
- We do not sell your personal data to third parties
- We do not use your monitoring data for advertising purposes
- We retain monitoring data per the plan-based retention schedule described in our Privacy Policy
- Upon account deletion, all your data is permanently deleted within 30 days (except payment records retained for legal compliance)
12. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and circumstances of disclosure.
This obligation does not apply to information that:
- Is or becomes publicly known through no fault of the receiving party
- Was known to the receiving party before disclosure
- Is received from a third party without restriction
- Is required to be disclosed by law or court order
This confidentiality obligation survives the termination of these Terms for a period of 3 years.
13. Disclaimer of Warranties
Important Legal Notice
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINGZO PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. PINGZO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
14. Limitation of Liability
14.1 Exclusion of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINGZO, AUREXIS TECHNOLOGIES PRIVATE LIMITED, OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14.2 Cap on Total Liability
To the maximum extent permitted by applicable law, Pingzo's total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Service shall not exceed the greater of:
- The total amount paid by you to Pingzo in the three (3) months immediately preceding the event giving rise to the claim, OR
- One hundred United States Dollars (USD $100) or the equivalent in your local currency
14.3 Essential Basis
The limitations of liability in this Section reflect a reasonable allocation of risk between you and Pingzo and form an essential basis of the bargain between the parties. Pingzo would not be able to provide the Service at current pricing without these limitations.
14.4 Jurisdiction-Specific Provisions
- The above limitations apply to the fullest extent permitted by applicable law
- EU/UK consumers: nothing in these Terms limits your statutory consumer rights under EU or UK law
- Australian consumers: nothing in these Terms limits your rights under the Australian Consumer Law
- Indian consumers: nothing in these Terms limits your rights under the Consumer Protection Act 2019
15. Indemnification
You agree to defend, indemnify, and hold harmless Pingzo, Aurexis Technologies Private Limited, and their respective directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use/misuse of the Service.
16. Termination
16.1 Termination by You
You may terminate your account at any time by using the account deletion feature in Settings → Danger Zone or by emailing admin@pingzoapp.com.
16.2 Termination by Pingzo
We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, or we believe your use poses a security risk or legal liability.
16.3 Effect of Termination
Upon termination, your right to access the Service immediately ceases, and all your monitoring data will be permanently deleted within 30 days.
17. Dispute Resolution
17.1 Informal Resolution
Before formal dispute resolution, you agree to contact us at admin@pingzoapp.com. We will attempt to resolve the dispute informally within 30 days.
17.2 Binding Arbitration
For users outside EU/UK, informal resolution failure leads to binding arbitration rather than court action, except small claims court where eligible.
17.3 EU/UK Consumer Rights
EU/UK consumers retain the right to bring claims in the courts of their country of residence.
17.4 Class Action Waiver
Dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.

19. Changes to These Terms
We may update these Terms. Material changes notified 30 days in advance via email. Continued use constitutes acceptance.
20. Miscellaneous
These Terms constitute the entire agreement. If any part is invalid, the rest remains in effect. We are not liable for delays caused by Force Majeure events.
